Floating menu on top of all applications


I want to make the menu floating over all applications. I saw this question: Creating a system overlay window (always on top)

but I want it to work in ICS as well.
There is a GameCIH application that has such an interface that supports touch in ICS: enter image description here

How is this possible? Thank!
